Airbus Reached Settlement with Bankruptcy Administrator of East Star Airlines


 

Run Ming represented Airbus S.A.S. in the bankruptcy proceedings against East Star Airlines, the first airlines that was ever declared bankrupt so far in China. While assisting Airbus in filing its claims in the bankruptcy proceedings, Run Ming advised Airbus on Chinese bankruptcy law issues.  Run Ming also represented Airbus in related lawsuits and arbitration matters in defending Airbus against counterclaims from the airlines.  After eight months of intensive negotiating, Airbus and the bankruptcy administrator recently reached a general settlement agreement.  This result effectively prevented a series of potential time-consuming and costly international arbitration and cross-border lawsuits in China. In this case, we as the legal counsel dealt with a number of innovative legal issues.  We assisted our client in formulating solutions in areas where no PRC statutory rules are directly applicable or no judicial precedents have been established for us to follow. With the seamless cooperation between the Run Ming team and the foreign legal counsel, Airbus successfully implemented important precautious measures, and, as a result, the client's core interests were well protected.  This also paved the path for a general settlement without further arbitration and litigation.
